Confidentiality
평가의 객관성과 신뢰성을 확보하기 위해서는 평가과정에서 취득하거나 생성되는 정보가 그 성격과 목적에 따라 적절하게 관리되어야 한다. 평가업무를 수행하는 과정에서는 일반에 공개되지 않은 자료와 정보, 평가를 위해 제출된 자료, 검토·심의 과정에서 생성되는 정보 등 보호가 필요한 정보가 포함될 수 있기 때문이다.
To safeguard the Objectivity and Reliability of Evaluation, information obtained or generated during the evaluation process must be appropriately managed according to its nature and purpose. Evaluation activities may involve information requiring protection, including materials and information not publicly available, materials submitted for evaluation, and information generated through review and deliberation.
SEC(Sustainable Enterprise Evaluation Commission)는 평가과정에서 취득하거나 생성되는 비공개 정보와 보호가 필요한 자료를 정해진 기준과 절차에 따라 관리하고, 평가업무 수행에 필요한 범위를 벗어나 부당하게 이용되거나 제공되지 않도록 한다.
SEC (Sustainable Enterprise Evaluation Commission) manages non-public information and protected materials obtained or generated during the evaluation process in accordance with established standards and procedures and ensures that such information is not improperly used or disclosed beyond the scope necessary for evaluation activities.
Ⅰ. 비밀유지의 기본원칙
I. Fundamental Principles of Confidentiality
SEC는 평가정보의 성격, 공개 여부 및 보호 필요성을 고려하여 평가과정에서 취득하거나 생성되는 정보를 적절하게 관리한다.
SEC appropriately manages information obtained or generated during the evaluation process in consideration of its nature, disclosure status, and need for protection.
일반에 공개된 정보와 정해진 절차에 따라 공개되는 정보는 비밀유지의 대상이 되는 비공개 정보와 구분하여 관리한다.
Information already available to the public and information disclosed through established procedures are managed separately from non-public information subject to confidentiality requirements.
비밀유지는 정당한 정보공개를 제한하기 위한 것이 아니라 보호가 필요한 정보를 적절하게 관리하여 평가대상기관의 권익과 평가과정의 신뢰성을 보호하기 위한 것이다.
Confidentiality is not intended to restrict legitimate disclosure of information but to protect the rights and interests of evaluation subjects and the Reliability of the evaluation process through appropriate management of information requiring protection.
Ⅱ. 보호가 필요한 평가정보
II. Evaluation Information Requiring Protection
평가과정에서 평가대상기관으로부터 제출받은 비공개 자료와 일반에 공개되지 않은 정보는 그 성격과 보호 필요성에 따라 관리한다.
Non-public materials submitted by evaluation subjects and information not available to the public are managed according to their nature and need for protection.
평가업무 수행과정에서 생성되는 내부 검토자료, 평가와 관련한 비공개 기록 및 그 밖에 공개가 적절하지 않은 정보 역시 정해진 기준과 절차에 따라 관리한다.
Internal review materials generated during evaluation activities, non-public records relating to evaluations, and other information not appropriate for disclosure are likewise managed in accordance with established standards and procedures.
정보의 보호 여부는 단순히 자료의 형식이나 명칭만으로 판단하지 않고 해당 정보의 성격, 공개 여부, 평가업무와의 관련성 및 보호 필요성을 고려한다.
Whether information requires protection is determined not solely by its format or title but in consideration of its nature, disclosure status, relevance to evaluation activities, and need for protection.
Ⅲ. 평가정보의 목적 내 이용
III. Use of Evaluation Information for Authorized Purposes
평가과정에서 취득한 비공개 정보와 보호가 필요한 자료는 평가업무 수행에 필요한 목적과 범위에서 이용한다.
Non-public information and protected materials obtained through the evaluation process are used only for purposes and within the scope necessary for evaluation activities.
평가위원과 임직원 및 평가업무 수행자는 평가정보를 개인적 목적이나 자신 또는 제3자의 사적·경제적·사업적 이익을 위하여 이용해서는 안 된다.
Evaluation Committee members, employees, and other persons engaged in evaluation activities must not use evaluation information for personal purposes or for the private, economic, or business benefit of themselves or third parties.
평가업무를 통해 취득한 정보를 평가목적과 관계없는 업무나 활동에 임의로 이용해서는 안 된다.
Information obtained through evaluation activities must not be used without authorization for activities or purposes unrelated to the evaluation.
Ⅳ. 평가정보에 대한 접근과 공유
IV. Access to and Sharing of Evaluation Information
비공개 정보와 보호가 필요한 평가자료는 평가업무 수행에 필요한 범위에서 접근하고 이용한다.
Access to and use of non-public information and protected evaluation materials are limited to the extent necessary for evaluation activities.
평가업무 수행에 필요하지 않은 자에게 비공개 정보나 보호가 필요한 자료를 임의로 제공하거나 공유해서는 안 된다.
Non-public information or protected materials must not be provided or shared without authorization with persons who do not require such information for evaluation activities.
업무상 평가정보를 공유할 필요가 있는 경우에도 해당 정보의 성격과 보호 필요성을 고려하여 필요한 범위에서 공유한다.
Even where evaluation information must be shared for legitimate business purposes, it is shared only to the extent necessary, taking into account the nature of the information and its need for protection.
Ⅴ. 평가위원과 임직원의 비밀유지 책임
V. Confidentiality Responsibilities of Evaluation Committee Members and Employees
평가위원과 임직원 및 평가업무 수행자는 업무상 취득한 비공개 정보와 보호가 필요한 평가자료를 책임 있게 관리해야 한다.
Evaluation Committee members, employees, and other persons engaged in evaluation activities must responsibly manage non-public information and protected evaluation materials obtained through their duties.
자신의 직위나 평가권한을 이용하여 비공개 평가정보를 부당하게 취득하거나 권한이 없는 자에게 제공해서는 안 된다.
They must not use their position or evaluation authority to improperly obtain non-public evaluation information or provide such information to unauthorized persons.
평가업무와 관련한 역할이 변경되거나 해당 평가업무에 더 이상 참여하지 않는 경우에도 업무상 취득한 비공개 정보를 정당한 권한 없이 이용하거나 공개해서는 안 된다.
Where an individual’s role changes or the individual no longer participates in the relevant evaluation activities, non-public information obtained through those duties must not be used or disclosed without legitimate authority.
Ⅵ. 평가위원회 심의와 비밀유지
VI. Confidentiality in Evaluation Committee Deliberations
평가위원회의 검토와 심의과정에서는 평가위원들이 독립적으로 전문적인 의견을 제시하고 충분한 논의를 할 수 있는 환경이 보장되어야 한다.
The review and deliberation process of the Evaluation Committee must provide an environment in which members can independently express professional opinions and engage in sufficient discussion.
평가위원회 심의과정에서 취득하거나 생성되는 비공개 정보와 보호가 필요한 내용은 정해진 기준과 절차에 따라 관리한다.
Non-public information and protected content obtained or generated during Evaluation Committee deliberations are managed in accordance with established standards and procedures.
평가위원 개인의 전문적 의견이나 심의과정의 비공개 내용을 정당한 권한이나 절차 없이 외부에 공개해서는 안 된다.
Individual professional opinions of Evaluation Committee members or non-public content from the deliberation process must not be disclosed externally without legitimate authority or established procedures.
Ⅶ. 정보공개와 비밀유지의 구분
VII. Distinction between Disclosure and Confidentiality
비밀유지 원칙은 SEC가 정해진 기준과 절차에 따라 평가결과와 필요한 평가정보를 공개하는 것을 제한하지 않는다.
The principle of Confidentiality does not restrict SEC from disclosing evaluation results and necessary evaluation information in accordance with established standards and procedures.
평가결과의 공표, 평가등급의 공개 또는 그 밖에 공개가 결정된 정보는 관련 기준과 절차에 따라 공개한다.
Evaluation results, Ratings, and other information designated for disclosure are made public in accordance with applicable standards and procedures.
다만 평가결과가 공개되는 경우에도 평가과정에서 취득한 모든 비공개 자료나 내부 검토정보가 함께 공개되는 것은 아니며, 보호가 필요한 정보는 계속하여 관련 기준과 절차에 따라 관리한다.
However, disclosure of evaluation results does not mean that all non-public materials or internal review information obtained during the evaluation process are also disclosed. Information requiring protection continues to be managed in accordance with applicable standards and procedures.
Ⅷ. 비밀유지 책임의 지속
VIII. Continuing Confidentiality Obligations
비밀유지 책임은 특정 평가단계에 한정되지 않고 평가자료의 수집과 검증, 평가와 심의, 평가결과 확정 및 그 이후에도 해당 정보가 비공개로 보호될 필요가 있는 동안 지속된다.
Confidentiality obligations are not limited to a particular stage of evaluation. They continue through the collection and verification of evaluation materials, evaluation and deliberation, finalization of evaluation results, and thereafter for as long as the relevant information requires non-public protection.
평가업무가 종료되거나 평가위원·임직원 등의 평가업무 참여가 종료되었다는 이유만으로 업무상 취득한 비공개 정보를 임의로 이용하거나 공개해서는 안 된다.
The completion of an evaluation or the end of an Evaluation Committee member’s, employee’s, or other person’s participation in evaluation activities does not permit the unauthorized use or disclosure of non-public information obtained through those activities.
SEC는 이러한 비밀유지 원칙을 통해 평가대상기관으로부터 취득한 정보와 평가과정에서 생성되는 보호가 필요한 정보를 적절하게 관리하고, 평가정보에 대한 책임 있는 관리와 필요한 정보공개가 조화를 이루도록 한다.
Through these principles of Confidentiality, SEC appropriately manages information obtained from evaluation subjects and protected information generated during the evaluation process, maintaining an appropriate balance between responsible management of evaluation information and necessary disclosure.
