Prohibition of Improper Interference with Evaluation Results

 

 

 

평가결과에 대한 신뢰를 확보하기 위해서는 평가과정에서 도출된 전문적 판단과 평가결과가 경영상의 이해관계, 경제적·사업적 관계 또는 외부와 내부의 부당한 영향에 따라 임의로 변경되지 않아야 한다. 평가결과가 객관적인 평가근거가 아니라 특정한 이해관계나 요구에 따라 좌우된다면 평가의 독립성과 공정성은 유지될 수 없기 때문이다.

 

To maintain confidence in evaluation results, professional judgments and evaluation results derived through the evaluation process must not be arbitrarily altered because of management interests, economic or business relationships, or undue external or internal influence. The Independence and Fairness of Evaluation cannot be maintained if evaluation results are determined by particular interests or demands rather than objective evaluation evidence.

 

SEC(Sustainable Enterprise Evaluation Commission)는 개별 평가에 관한 전문적 판단과 평가결과가 객관적인 자료와 검증 가능한 정보, SEC 평가방법론(SEC Evaluation Methodology), SEC 평가체계(SEC Evaluation Framework) 및 정해진 평가절차에 따라 도출되도록 하며, 정당한 권한과 절차를 벗어난 평가결과에 대한 부당한 개입을 허용하지 않는다.

 

SEC (Sustainable Enterprise Evaluation Commission) ensures that professional judgments and results concerning individual evaluations are derived on the basis of objective data, verifiable information, the SEC Evaluation Methodology, the SEC Evaluation Framework, and established evaluation procedures, and does not permit improper interference with evaluation results outside legitimate authority and procedures.

 

 

 

Ⅰ. 평가결과 개입 금지의 기본원칙

I. Fundamental Principle Prohibiting Interference with Evaluation Results

 

 

개별 평가에 관한 판단과 평가결과는 정해진 평가기준과 절차에 따라 결정하며, 특정 개인이나 조직의 이해관계 또는 요구를 이유로 임의로 변경해서는 안 된다.

 

Judgments and results concerning individual evaluations are determined in accordance with established evaluation criteria and procedures and must not be arbitrarily altered because of the interests or demands of a particular individual or organization.

 

경영진, 평가대상기관, 이해관계자 또는 기타 내부·외부 관계자는 정당한 평가절차를 벗어나 특정 평가대상에 유리하거나 불리한 평가결과를 요구하거나 이를 관철하기 위하여 평가에 개입해서는 안 된다.

 

Management, evaluation subjects, stakeholders, and other internal or external parties must not, outside legitimate evaluation procedures, demand favorable or unfavorable evaluation results for a particular evaluation subject or interfere with an evaluation in order to obtain such results.

 

SEC는 평가결과에 영향을 미칠 수 있는 권한이나 관계가 특정한 평가결과를 만들기 위한 수단으로 이용되지 않도록 한다.

 

SEC ensures that authority or relationships capable of influencing evaluation results are not used as a means of producing a particular evaluation outcome.

 

 

 

Ⅱ. 경영상의 이해관계에 따른 개입 금지

II. Prohibition of Interference Based on Management Interests

 

 

회사의 경영상 필요나 사업상 이해관계는 그 자체로 개별 평가결과를 변경할 수 있는 근거가 될 수 없다.

 

Management needs or business interests of the company must not, in themselves, serve as a basis for changing an individual evaluation result.

 

경영진은 거래관계의 유지·확대, 사업상 이익, 재정적 고려 또는 기타 경영상의 이해를 이유로 특정 평가대상의 평가결과·평가등급 또는 인증결정을 유리하거나 불리하게 변경하도록 요구해서는 안 된다.

 

Management must not require evaluation results, Ratings, or Certification decisions concerning a particular evaluation subject to be changed favorably or unfavorably for reasons such as maintaining or expanding business relationships, securing business interests, financial considerations, or other management interests.

 

경영상의 판단과 개별 평가에 관한 전문적 판단은 각각의 권한과 책임에 따라 구분한다.

 

Management judgment and professional judgment concerning individual evaluations are distinguished according to their respective authority and responsibilities.

 

 

 

Ⅲ. 경제적·사업적 관계에 따른 개입 금지

III. Prohibition of Interference Based on Economic or Business Relationships

 

 

SEC와 평가대상 사이에 경제적·사업적 관계가 존재하거나 평가대상이 SEC에 재정적으로 기여하였다는 사실은 개별 평가결과·평가등급 또는 인증결정을 유리하거나 불리하게 변경하는 근거가 될 수 없다.

 

The existence of an economic or business relationship between SEC and an evaluation subject, or the fact that an evaluation subject has made a financial contribution to SEC, must not serve as a basis for favorably or unfavorably changing individual evaluation results, Ratings, or Certification decisions.

 

경제적·사업적 관계의 유지 또는 확대를 목적으로 특정 평가결과를 요구하거나 전문적 평가판단을 변경하도록 해서는 안 된다.

 

A particular evaluation result must not be demanded, nor may professional evaluation judgment be altered, for the purpose of maintaining or expanding an economic or business relationship.

 

SEC는 평가결과·평가등급 또는 인증결정의 유리한 변경을 조건으로 금전적 또는 기타 경제적 이익을 요구하거나 제공받지 않는다.

 

SEC does not request or accept monetary or other economic benefits in exchange for favorable changes to evaluation results, Ratings, or Certification decisions.

 

 

 

Ⅳ. 외부 및 내부의 부당한 개입 금지

IV. Prohibition of Undue External and Internal Interference

 

 

평가대상기관, 이해관계자 또는 기타 외부 관계자는 정당한 평가절차를 벗어나 특정 평가결과를 요구하거나 전문적 평가판단을 변경하도록 부당한 영향력을 행사해서는 안 된다.

 

Evaluation subjects, stakeholders, and other external parties must not, outside legitimate evaluation procedures, demand a particular evaluation result or exert undue influence to alter professional evaluation judgment.

 

경영진, 임직원 또는 기타 내부 관계자 역시 자신의 직위·권한 또는 업무상 영향력을 이용하여 특정 평가결과를 요구하거나 평가판단을 특정 방향으로 변경하도록 해서는 안 된다.

 

Management, employees, and other internal parties must likewise not use their position, authority, or operational influence to demand a particular evaluation result or cause evaluation judgment to be altered in a particular direction.

 

평가위원장, 평가위원 및 평가업무 수행자는 이러한 부당한 요구나 영향에 따라 전문적 판단을 변경해서는 안 된다.

 

The Chair of the Evaluation Committee, Evaluation Committee members, and persons engaged in evaluation activities must not alter their professional judgments in response to such improper demands or influence.

 

 

 

Ⅴ. 정당한 검토와 부당한 개입의 구분

V. Distinction between Legitimate Review and Improper Interference

 

 

평가결과 개입 금지는 평가과정에서 필요한 전문적 검토·검증·심의 또는 정당한 절차에 따른 평가내용의 변경을 제한하는 것을 의미하지 않는다.

 

The prohibition of interference with evaluation results does not restrict professional review, verification, deliberation, or changes to evaluation findings made through legitimate procedures where necessary during the evaluation process.

 

평가자료의 오류나 새로운 사실관계가 확인되거나, 전문적인 검토와 평가위원회 심의, 사실확인 또는 이의신청 등을 통해 평가내용의 수정이 필요하다고 판단되는 경우에는 객관적인 근거와 정해진 절차에 따라 이를 반영한다.

 

Where errors in evaluation materials or new facts are identified, or where professional review, Evaluation Committee deliberation, Factual Review, or Appeal establishes the need to revise evaluation findings, such matters are reflected on the basis of objective grounds and established procedures.

 

정당한 절차에 따른 평가내용의 검토·수정·정정과 특정 이해관계나 부당한 요구에 따른 평가결과의 변경은 명확하게 구분한다.

 

Review, revision, or correction of evaluation findings through legitimate procedures is clearly distinguished from changes to evaluation results arising from particular interests or improper demands.

 

 

 

Ⅵ. 평가결과 확정과 전문적 판단

VI. Finalization of Evaluation Results and Professional Judgment

 

 

평가결과는 정해진 평가절차에 따른 자료검증, 정량·정성평가, 전문적인 검토와 평가위원회 심의 및 필요한 사실확인 절차 등을 거쳐 확정한다.

 

Evaluation results are finalized through established evaluation procedures, including data verification, quantitative and qualitative evaluation, professional review, Evaluation Committee deliberation, and necessary Factual Review procedures.

 

평가결과를 확정하는 과정에서도 개인이나 조직의 지위·권한·경제적 관계 또는 기타 이해관계가 전문적 평가판단을 대신할 수 없다.

 

Even during the finalization of evaluation results, the position, authority, economic relationships, or other interests of an individual or organization must not replace professional evaluation judgment.

 

최종 평가결과는 정해진 평가기준과 절차에 따른 전문적 판단을 바탕으로 확정한다.

 

Final evaluation results are determined on the basis of professional judgment exercised in accordance with established evaluation criteria and procedures.

 

 

 

Ⅶ. 평가결과 확정 이후의 변경

VII. Changes after Finalization of Evaluation Results

 

 

최종 평가결과가 확정된 이후에도 객관적인 사실오류, 자료의 중대한 오류 또는 정해진 절차에 따라 정정이 필요한 사유가 확인된 경우에는 관련 기준과 절차에 따라 필요한 검토와 정정을 실시한다.

 

Even after final evaluation results have been finalized, where an objective factual error, material error in evaluation materials, or other grounds requiring correction under established procedures are identified, necessary review and correction are conducted in accordance with applicable standards and procedures.

 

평가결과가 확정되었다는 이유만으로 객관적으로 확인된 오류를 유지하지 않으며, 반대로 단순한 요구나 이해관계를 이유로 확정된 평가결과를 변경하지 않는다.

 

An objectively verified error is not maintained merely because the evaluation result has been finalized. Conversely, a finalized evaluation result is not changed merely because of a request or particular interest.

 

평가결과의 변경이나 정정은 객관적인 근거와 정해진 권한 및 절차에 따라 이루어진다.

 

Any change or correction to evaluation results is made on the basis of objective grounds and in accordance with established authority and procedures.

 

 

Ⅷ. 평가결과의 독립성 보호

VIII. Protection of the Independence of Evaluation Results

 

 

평가결과 개입 금지는 특정 개인이나 조직으로부터 평가결과를 고립시키기 위한 것이 아니라, 평가결과가 객관적인 평가근거와 전문적 판단에 따라 도출되도록 보호하기 위한 것이다.

 

The prohibition of interference with evaluation results is not intended to isolate evaluation results from any particular individual or organization but to protect the process by which results are derived from objective evaluation evidence and professional judgment.

 

SEC는 평가결과에 영향을 미치려는 부당한 개입을 차단하는 동시에 정당한 검토·검증·심의·사실확인 및 이의신청 절차를 보장함으로써 평가결과의 정확성과 공정성을 함께 확보한다.

 

SEC protects both the accuracy and Fairness of evaluation results by preventing improper interference while ensuring legitimate review, verification, deliberation, Factual Review, and Appeal procedures.

 

이를 통해 SEC는 개별 평가결과·평가등급 및 인증결정이 경영상의 이해관계나 외부 또는 내부의 부당한 영향이 아니라 객관적인 자료와 검증 가능한 정보 및 정해진 평가원칙과 절차에 따라 결정되도록 한다.

 

Through these measures, SEC ensures that individual evaluation results, Ratings, and Certification decisions are determined not by management interests or undue external or internal influence, but by objective data, verifiable information, and established evaluation principles and procedures.
